Regulation (EU) 2024/1106 of the European Parliament and the Council of 11th April 2024 amending Regulations (EU) No 1227/2011 and (EU) 2019/942 as regards improving the Union’s protection against market manipulation on the wholesale energy market has been published in the Official Journal of the European Union and enters into force on 7th May 2024, where implementation dates for some of the provisions will vary.
REMIT II is a first- level amendment of the initial REMIT Regulation and comprises a number of topics. The main amendments are as follows:
- New definitions of several terms, including ‘wholesale energy products’, ‘ inside information’ and ‘market manipulation’;
- Requirements on algorithmic trading on power markets;
- New requirements to the scope of reporting obligations;
- A requirement to non-EU entities to have a ‘ designated representative’ in EU;
- Expansion of the regular surveillance scope of the Agency of the Cooperation of Energy Regulators (ACER).
The amendments also include new requirements to organized marketplaces, registered reporting mechanisms, inside information platforms, etc.
ACER has published an Open letter addressing stakeholders’ questions in order to help them comply with their reporting obligations under REMIT II.
