According to the Copyright and Neighbouring Rights Act (CNRA), the holder of the copyright in a database is the producer of the database, which is the legal entity that has taken the initiative and the risk of investing in the collection, verification or use of the contents of the database, if such an investment is material in quantitative or qualitative terms.
IBEX has the status of a “database producer”, in this capacity being the holder of all rights to the database containing the information and data obtained as a result of the operation of the organized power exchange market.
The provisions of the CNRA recognize the database producer’s right to prohibit the retrieval and reuse of the contents of the database or a substantial part thereof. Unauthorized retrieval and use of the database contents may result in legal actions being taken.
Non-commercial retrieval of the disclosed contents of the database for educational or scientific research purposes is permitted to the extent justified by the purpose, provided the source is acknowledged, as well as the retrieval and reuse of a non-essential part of the disclosed database contents. The retrieval and use of the database in any other way and for any other purpose is permitted only with the explicit consent of IBEX.
